第1条（総則）

本規約は、ProgrezTribe Discord サーバーおよび付随するサービス（以下「本サービス」といいます）の利用に関する条件を定めるものです。本サービスの利用者は、本規約の内容を理解し、同意した上で本サービスを利用するものとします。

第2条（利用料金および支払い）

本サービスの利用には、別途定める利用料金が発生します。
利用料金、支払い方法、支払い期日等は、別途定めるものとします。
利用者は、定められた期日までに利用料金を支払うものとします。
利用者の都合による返金は原則として行いません。

第3条（禁止事項）

利用者は、本サービスの利用にあたり、以下の行為を行ってはならないものとします。

法令または公序良俗に違反する行為
他の利用者、第三者、または本サービス運営者の権利（著作権、商標権、名誉、信用、プライバシーを含む一切の権利）を侵害する行為、ならびに特定の利用者個人に対し、誹謗中傷、侮辱、脅迫、嫌がらせ、精神的な苦痛または不快感を与える一切の言動（個人攻撃を含む）を行う行為
本サービス運営者が録画または録音を許可している場合、またはその旨を事前に告知している場合を除き、他の利用者の音声、映像、または投稿内容について、事前に許可を得ることなく録画、録音、またはその他の方法で記録する行為
わいせつ、児童ポルノ、または児童虐待にあたる情報、またはそれらを想起させる情報を投稿または送信する行為
性差別、人種差別、自民族中心主義、健常者中心主義、同性愛嫌悪、トランス嫌悪、シス中心主義などに基づく発言をする行為、またはその恐れのある行為
相手方が事前に明確な同意を示した場合、または公共の利益に関わる正当な理由がある場合を除き、本サービスを通じて知り合った他の利用者に対し、ダイレクトメッセージ（DM）を送信する行為
他の利用者との対話、メッセージ、または投稿を通じて、特定の宗教やビジネスへの勧誘を行ったり、宣伝・広告などを発信する行為
本サービスの運営を妨害する行為、またはその恐れのある行為
スパム行為、または不特定多数の利用者にメッセージを送信する行為
有害なプログラムやスクリプト等を送信または投稿する行為
他の利用者の個人情報を収集、開示、または漏洩する行為
本サービスの内容（テキスト、音声、画像、動画等）のうち、利用者自身がその権利を有するものを除き、無断で転載、複製、改変、配布、公開する行為
その他、本サービス運営者が不適切と判断する行為（『サービス利用ガイドライン』を参照のこと）

第4条（免責事項）

本サービスの提供は、現状有姿で行われるものとし、本サービス運営者は、その内容、品質、安全性、信頼性、正確性、有用性、特定の目的への適合性について、明示または暗示を問わず、いかなる保証も行わないものとします。
本サービスの利用に関連して利用者に生じた損害について、本サービス運営者は一切の責任を負わないものとします。ただし、本サービス運営者の故意または重過失による場合はこの限りではありません。
本サービスの利用に関連して利用者間で紛争が生じた場合、利用者は自らの責任と費用においてこれを解決するものとし、本サービス運営者は一切関与しないものとします。

第5条（アカウントの停止・削除）

本サービス運営者は、利用者が以下のいずれかに該当する場合、事前の通知なく、当該利用者のサーバー利用を停止または削除することができるものとします。

本規約に違反した場合
利用料金の支払いを遅延した場合
長期間にわたり本サービスの利用がない場合
その他、本サービス運営者が不適切と判断した場合

第6条（規約の変更）

本サービス運営者は、必要と判断した場合、利用者に事前に通知することなく、本規約の内容を変更することができるものとします。変更後の規約は、本サービス上に掲載された時点から効力を生じるものとします。利用者は、変更後の規約についても同意したものとみなされます。

第7条（知的財産権）

本サービスに掲載されているすべてのコンテンツ（テキスト、音声、画像、動画等）に関する著作権、商標権、その他の知的財産権は、本サービス運営者または正当な権利者に帰属します。利用者は、利用者自身がその権利を有するものを除き、これらのコンテンツを無断で使用（複製、転載、改変、配布、公開等）することはできません。

第8条（準拠法および管轄裁判所）

本規約の準拠法は日本法とします。本規約または本サービスの利用に関連して生じた一切の紛争については、さいたま地方・家庭裁判所越谷支部を第一審の専属的合意管轄裁判所とします。

第9条（その他）

本規約に定めのない事項については、別途本サービス運営者が定めるものとします。

サービス利用ガイドライン

本ガイドラインは利用規約と合わせて、本サービス利用におけるコミュニケーションの指針としてご参照ください。

このコミュニティは厳密な総意に基づいたコミュニティではなく、「反差別」や「包摂」など政治的進歩派に共通する価値観に基づいたものです。一度の会話で相手を説得しようとしないでください。意見が違うんだなということを受け止めるべき時もあります。
無知は社会における特権の結果として生じやすいことを理解し、他者の無知には寛容に、自身の無知には謙虚でありましょう。
全てのメンバーは互いを尊重し合うこと、そして健康的な議論の文化を醸成しようと努力することを求められます。
このコミュニティはセーフスペースではなく、セーファースペース（安全なのではなく、より安全であることを目指す場）です。
研究者、報道関係者、その他一定規模以上の発信プラットフォームを持つ人は、本サービス利用中に見聞きした他者の視点、意見、考えなどを盗用しないよう十分に注意してください。適切なクレジット（誰の視点、意見、考えであるかを示すもの）を付けずに発表されたものは盗作となりますので、あなたの所属する機関や出版社に報告したり、公にあなたを非難することになります。
トリガーウォーニングの適切な利用は推奨されます。
利用規約にある通り、当サーバーで知った相手に対してDMを送ることは禁止です。メンバーはこのサーバー経由でのDMを受け付けない設定にすることをおすすめします。
議論が加熱した場合には低速モード（当該チャンネルのみメッセージ送信の頻度を制限する機能）を適用します。
規約違反が見られた場合、利用規約の通りに即利用停止とするのではなく、イエローカードを出します。3回のイエローカードで、当該メンバーはその場から退場となります。退場時、運営者から当該人物に説明をすることはありません。有料会員だった場合、それ以降の支払いはキャンセルされます。
利用規約にある通り、本サービス利用中に発生した利用者間のトラブルや損害について本サービス運営者は（自身がその発生理由に関わっている場合を除き）責任を負いませんが、手に負えないほどの状況でない限り、当事者らと運営者のみアクセス可能なテキストチャンネルを作りそこで協議を促すなど、解決に向けた努力をします。ただしサービスの存続が危ぶまれるなど非常に極端な状況になった場合は、当事者のサービス利用を停止することもあります。

Terms of Service

Article 1 (General Provisions)

These Terms of Use stipulate the conditions for using the ProgrezTribe Discord server and its accompanying services (hereinafter referred to as the "Service"). Users of the Service shall use the Service after understanding and agreeing to the contents of these Terms.

Article 2 (Usage Fees and Payment)

A separate usage fee will be charged for the use of the Service.
Usage fees, payment methods, payment due dates, etc., shall be determined separately.
Users shall pay the usage fees by the specified due date.
Refunds will not be provided in principle due to personal reasons or changes in circumstance.

Article 3 (Prohibited Conduct)

Users shall not engage in the following conduct when using the Service:

Conduct that violates laws or public order and morals.
Conduct that infringes on the rights (including but not limited to copyrights, trademarks, reputation, credibility, and privacy) of other users, third parties, or the Service operator, as well as any speech or behavior that defames, insults, threatens, harasses, or causes mental distress or discomfort to a specific individual user (including personal attacks).
Recording, audio recording, or otherwise recording the voice, video, or posted content of other users without their prior consent, unless the Service operator has permitted such recording or has announced it in advance.
Posting or transmitting information that is obscene, child pornography, or child abuse, or that evokes such content.
Making statements based on or likely to cause discrimination based on gender, race, ethnocentrism, ableism, homophobia, transphobia, or ciscentrism.
Sending direct messages (DMs) to other users met through the Service without their explicit prior consent, unless there is a legitimate reason involving public interest.
Engaging in solicitation for specific religions or businesses, or sending advertisements or promotional materials through dialogue, messages, or posts with other users.
Conduct that interferes with the operation of the Service or is likely to do so.
Spamming or sending messages to an unspecified large number of users.
Transmitting or posting harmful programs or scripts.
Collecting, disclosing, or leaking the personal information of other users.
Unauthorized reproduction, copying, modification, distribution, or public release of the Service's content (text, audio, images, videos, etc.) unless said content is original work by the user themselves.
Any other conduct that the Service operator deems inappropriate (refer to the "Service Usage Guidelines").

Article 4 (Disclaimer)

The Service is provided on an "as is" basis, and the Service operator makes no warranties, express or implied, regarding its content, quality, safety, reliability, accuracy, usefulness, or fitness for a particular purpose.
The Service operator shall not be liable for any damages incurred by users in connection with the use of the Service, except in cases of intentional¹misconduct or gross negligence on the part of the Service operator.
In the event of a dispute between users in connection with the use of the Service, the users shall resolve the dispute at their own responsibility and expense, and the Service operator shall not be involved in any way.

Article 5 (Account Suspension/Deletion)

The Service operator may, without prior notice, suspend or delete a user's server access if the user falls under any of the following:

Violation of these Terms.
Delay in payment of usage fees.
Lack of use of the Service for a long period.
Any other case where the Service operator deems it inappropriate.

Article 6 (Changes to the Terms)

The Service operator may change the contents of these Terms without prior notice to users when deemed necessary. The revised Terms shall become effective when posted on the Service. Users shall be deemed to have agreed to the revised Terms as well.

Article 7 (Intellectual Property Rights)

All copyrights, trademarks, and other intellectual property rights related to all content posted on the Service (text, audio, images, videos, etc.) belong to the Service operator or the legitimate rights holders. Users may not use (reproduce, reprint, modify, distribute, publish, etc.) this content without permission unless said content is original work by the user themselves.

Article 8 (Governing Law and Jurisdiction)

These Terms shall be governed by the laws of Japan. The Saitama District and Family Court, Koshigaya Branch, shall be the exclusive agreement jurisdictional court of first instance for all disputes arising in connection with these Terms or the use of the Service.

Article 9 (Other Provisions)

Matters not stipulated in these Terms shall be determined separately by the Service operator.

Service Usage Guidelines

These Guidelines should be read in conjunction with the Terms of Use and serve as a guide for communication when using the Service.

This community is not based on strict consensus but on values shared among political progressives, such as "anti-discrimination" and "inclusion." Please do not try to persuade others in a single conversation. There are times when you should agree to disagree.
Understanding that ignorance often arises from privileged positions in society, it is important to be tolerant of others' ignorance while being humble about one's own.
All members are expected to respect each other and strive to foster a culture of healthy discussion.
This community is not a safe space but a safer space (a place that aims to be more safe, not inherently safe).
Researchers, journalists, and others with platforms of a certain scale must take great care not to plagiarize the perspectives, opinions, or ideas of others encountered while using the Service. Publishing without proper credit (indicating whose perspective, opinion, or idea it is) constitutes plagiarism and may result in reports to your institution or publisher, or public condemnation.
The appropriate use of trigger warnings is recommended.
As stated in the Terms of Use, sending DMs to individuals you have met on this server is prohibited. Members are encouraged to set their server-specific DM settings to "Do Not Allow Direct Messages."
If discussions become heated, low-speed mode (a function that limits the frequency of message sending only in the relevant channel) will be applied.
If a violation of the Terms is found, instead of immediately suspending usage as per the Terms, a yellow card will be issued. Three yellow cards will result in the removal of the member from either the server or the venue of a physical event. The Service operator do not owe an explanation to the individual upon removal. If the member is a paid member, subsequent payments will be canceled.
As stated in the Terms of Use, the Service operator is not responsible for conflicts or damages between users that occur during the use of the Service (unless the operator is involved in the cause of the occurrence), but will make efforts to resolve issues, for example by creating a text channel accessible only to the parties involved and the operator to facilitate discussion, unless the situation is beyond their control. However, in extremely critical situations, such as when the continuation of the Service is jeopardized, the Service operator may suspend the service usage of all the parties involved.
